Documents needed to provide when valuation real estate

According to the provisions of Article 107 of the Civil Code of the Socialist Republic of Vietnam in 2015, real estate includes: Land; Houses, construction works attached to land; Other properties attached to land, houses and construction works;

Thus, when it comes to real estate appraisal, depending on the types of properties mentioned above, the legal documents will be the legal documents accompanying each type of property. Specifically, the appraisal dossier includes:

Property is land (land use right)

  • Certificates of land use rights;
  • Decisions on land allocation, land lease/sublease;
  • Extract from the detailed regional planning map (if any).
  • Lease and sublease contracts;
  • Registration tax return;
  • Contract of transfer/donation/inheritance document; (if)
  • Details of the planning from the local competent authority or from the urban planning office (copy) (if any).
  • Other relevant papers;

Assets are houses and construction works attached to land

1. Certificate of property ownership;

2. Registration tax declaration;

3. As-built drawing or design drawing;

4. Dossier for settlement of works;

5. For work in progress, it is necessary to add:

  • Construction permit;
  • Contracts for consultancy, design and construction of works;
  • Construction technical design documents and total cost estimates;
  • The minutes of inspection and acceptance of the phase;
  • Documents and minutes of handling arising and changing during the construction process.

Property is an investment project

  • Investment License;
  • Planning drawing of 1/500 functional segment;
  • Certificate of architectural planning issued by a competent authority;
  • An explanation of the investment project together with the basic design documents;
  • Documents of commitment/agreement/memorandum or written permission for investment or decision approving investment project;
  • Agreements on land allocation, minutes defining boundaries and location of land plots;
  • Documents on investment incentives, tax exemption/reduction;
  • Transfer contract or capital contribution agreement of other investors;
  • Agreements on investment loans of credit institutions;
  • Certificate of guarantee of commercial bank (if any);
  • Other relevant documents.
